When is a Counselor not a Counselor at your Community College?
Resolving Confidentiality Issues for College Counselors, Faculty and Administrators
Today's community colleges employ a number of individuals who may be considered "counselors" yet serve in a variety of capacities. Even the terms "counselor" and "counseling" have taken on many meanings - Academic, Career, Personal, Disability Services and Mental Health treatment - are just a few that define the roles and areas that muddy the water in dealing with student's information. Add to that the mandated or encouraged reporting to Behavioral Intervention Teams, Threat Assessment Teams and Student Conduct Offices and the potential for an ethical, moral and legal mess increase for those who serve students (and sometimes faculty and staff) in grey areas regarding confidentiality, privilege and privacy. This webinar will help those professionals answer the questions that arise when FERPA, HIPPA, licensure requirements and potential personal, professional, and institutional liability seem to be in conflict.
Webinar content is specific to community colleges
This webinar will assist participants to develop a
- Better understanding how of FERPA, HIPPA and privilege intersect on their campus
- Identify who are the counselors on their campus and what level of privilege applies to each
- Examine and refine job descriptions, procedures and protocols to accomplish institutional goals and missions while complying with the laws regarding confidentiality
- Improve communication between staff and Behavioral Intervention Teams/Threat Assessment Teams on campus, as well as other campus partners.

For PC-based participants:
• Internet Explorer® 6.0 or newer, Mozilla® Firefox® 3.0 or newer (JavaScript™ and Java™ enabled)
• Windows® 2000, XP, 2003 Server, Vista, or Windows® 7
• Cable modem, DSL, or better Internet connection
• Minimum of Pentium® class 1GHz CPU with 512 MB of RAM (recommended) (2 GB of RAM for Windows® Vista)
Participants wishing to connect to audio using VoIP will need a fast Internet connection, a microphone and speakers (a USB headset is recommended).
For Mac-based participants:
• Safari™ 3.0 or newer, Firefox® 3.0 or newer (JavaScript™ and Java™ enabled)
• Mac OS® X 10.4 (Tiger®) or newer – Tiger®, Leopard® and Snow Leopard®
• PowerPC G4/G5 or Intel processor (512 MB of RAM or better recommended)

Handouts and webinar log-in instructions will be emailed to you approximately three days prior to the live webinar. Your registration includes one webinar log-in that is good for use at only one location. You may have multiple participants view the program at that location.
Participants may listen to the webinar via their computer speakers or dial a phone number provided in the log-in instructions. Please note that dialing in by phone will incur long distance charges.
Refund Policy
Refunds will be issued less a $35 administrative fee until 11:59 pm Central Time on Friday, September 3, 2010. No refunds will be issued after 11:59 pm Cental Time on Friday, September 17, 2010. All refund requests must be received in writing and may be sent to asca@tamu.edu.

W. Scott Lewis, JD is the president of ASCA, a partner with the National Center for Higher Education Risk Management (NCHERM), and serves as associate general counsel for Saint Mary's College in Indiana. He has been interviewed and/or featured by The Chronicle of Higher Education, Newsweek, NPR, NBC, USA Today, Today's Campus, as well as other publications and sources.
Mr. Lewis serves as an author and editor in a number of areas including legal issues in higher education, campus safety and student development, campus conduct board training, and other higher education issues. His recent works include Gamechanger: Reshaping Campus Sexual Misconduct Through Litigation, Threat Assessment in the Campus Setting, Second Generation Behavioral Intervention Team Practices, The Faculty Mentor Series, The Perfect Storm: Understand and Dealing with the New "Millennial" Student, Campus Safety 101, The Returning Veterans and "College and University Liability for Violent Campus Attacks" (Journal of College and University Law, April 2008).
Mr. Lewis has 20 years of experience serving as a student affairs administrator, faculty administrator, crisis/behavioral team chair, faculty member, corporate instructor, and consultant in higher education in both public and private institutions. He is a frequent keynote and plenary speaker, nationally recognized for his work on behavioral intervention for students in crisis and distress, classroom and office management, and dealing with disruptive students. Mr. Lewis presents and trains regularly throughout the country, assisting colleges, universities, and corporations with legal, judicial, and risk management issues, as well as policy development and implementation.
