Prior to the 2011 Dear Colleague Letter, an increase of complaints were filed with the Office of Civil Rights from female survivors who indicated their institution failed to protect them when acts of sexual misconduct occurred on campus. The 2011 Dear Colleague Letter required all institutions to alter and update their sexual misconduct policies, survivor resources, and investigation processes in addition to providing prevention and appointing a trained Title IX Coordinator/response team. This shift in investigation response from institutions when sexual misconduct incidents have been filed has led, in some cases, to disproportionate support for females and unfair treatment of accused male students. Nationwide, institutions of higher education are being sued by accused male students for failure to provide standard due process or equitable hearings. This webinar will address best practices in providing gender equitable practices in sexual misconduct investigations.
